These Terms of Service ("Terms") govern your access to and use of EasyWebie ("Service"), an AI-powered website builder operated by Web App Techie ("Company", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

EasyWebie provides a platform that allows users to create, edit, and publish websites using AI-assisted tools. Published websites are hosted on Cloudflare Pages infrastructure under subdomains such asyoursite.easywebie.comor, for eligible plans, custom domains you own.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you for any modification, suspension, or discontinuation of the Service.

2. Accounts

2.1 Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@easywebie.com if you suspect unauthorised access to your account.

2.2 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

2.3 One Account Per Person

Each user may maintain one account. Creating multiple accounts to circumvent plan limits or abuse free-tier resources is prohibited and may result in account termination.

3. Subscription Plans and Billing

3.1 Plans

EasyWebie offers the following plans:

Free: 1 website, 10 lifetime AI builds, publish to free EasyWebie subdomain, EasyWebie badge on site.
Basic ($4/month): 3 websites, 50 AI builds/month (5/day), badge removed, 1 custom domain, blog, email support.
Starter ($9/month): 10 websites, 120 AI builds/month (10/day), 30 Sonnet AI edits/month (top-up available), 3 custom domains, blog & e-commerce, 24hr support.
Pro ($19/month): Unlimited websites, 250 AI builds/month (15/day), 100 Sonnet AI edits/month, unlimited custom domains, blog & e-commerce, priority support within 4 hours, early access to new features.

Plan features and pricing may change. We will provide 30 days' notice of material price changes to existing subscribers.

3.2 Billing

Paid subscriptions are billed on a monthly recurring basis through Paddle.com, our Merchant of Record. Paddle handles all payment processing, invoicing, and applicable tax collection. By subscribing, you enter into a payment relationship with Paddle subject to their terms at paddle.com/legal.

3.3 Cancellation

You may cancel your subscription at any time through your account billing portal. Cancellation takes effect at the end of your current billing period. You retain access to paid features until the period ends. We do not provide prorated refunds for partial billing periods.

3.4 Refunds

We offer a 14-day money-back guarantee for first-time subscribers on any paid plan (Basic, Starter, or Pro). If you are not satisfied within 14 days of your first payment, contact us at support@easywebie.com and we will issue a full refund — no questions asked.

Beyond the 14-day window, refunds are handled on a case-by-case basis. If a technical issue on our end prevents you from using the Service and we are unable to resolve it within 7 business days of your report, you may request a refund for the affected billing period. Refunds are not provided for change of mind after the 14-day window, failure to cancel before renewal, or accounts that have violated our Terms of Service. See our Refund Policy for full details.

3.5 Plan Downgrade

If you cancel a paid subscription or downgrade to a lower plan, your account reverts to the new plan's limits at the end of your current billing period. If your account exceeds the new plan's limits (for example, you have more websites than the lower plan allows), you will have 30 days to bring your account within the new limits. After 30 days, websites exceeding the plan limit will be unpublished and placed in a read-only state — they will not be deleted. You may re-publish them at any time by upgrading your plan. Websites that remain over the limit for more than 90 days after downgrade may be permanently deleted.

3.6 Free Plan Limits

The Free plan is provided as-is with no uptime or availability guarantee. We reserve the right to apply reasonable usage limits to free accounts to prevent abuse and ensure service quality for all users.

4. Acceptable Use Policy

You agree not to use the Service to create, publish, or host content that:

Is illegal, fraudulent, defamatory, or infringes any third-party intellectual property rights
Contains malware, phishing pages, or any code designed to harm users
Promotes hatred, discrimination, violence, or harassment based on race, gender, religion, or any other protected characteristic
Involves adult content, gambling, or controlled substances in violation of applicable laws
Constitutes spam or unsolicited commercial communications
Impersonates another person, organisation, or brand
Violates any applicable law or regulation in your jurisdiction
Interferes with or disrupts our infrastructure or other users' use of the Service

We reserve the right to remove any content and suspend or terminate accounts that violate this policy, without prior notice, at our sole discretion.

5. AI-Generated Content

5.1 Responsibility

You are solely responsible for reviewing, editing, and publishing all AI-generated content. We do not guarantee the accuracy, completeness, originality, or appropriateness of AI-generated content. AI output may contain errors, outdated information, or hallucinations.

5.2 Ownership

Content you generate using our AI tools and subsequently publish is owned by you, subject to any limitations imposed by Anthropic's usage policies. We do not claim ownership over your generated content.

5.3 Third-Party AI

AI features are powered by Anthropic's Claude models. Your use of AI features is also subject to Anthropic's Acceptable Use Policy (anthropic.com/legal/aup). We may change the underlying AI provider at any time.

6. Your Content and Intellectual Property

6.1 Your Ownership and Warranties

You retain all ownership rights to the content you create or upload through the Service, including text, images, and website designs. You grant EasyWebie a non-exclusive, worldwide, royalty-free licence to host, store, and serve your content solely for the purpose of providing the Service.

By uploading or publishing any content through EasyWebie, you represent and warrant that: (a) you own the content or have all necessary licences, rights, consents, and permissions to use and authorise EasyWebie to host and display it; (b) the content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; and (c) you have obtained all required consents from any individuals identifiable in the content. If you upload images, videos, or other media that you do not own, you are solely responsible for any resulting copyright infringement claims. EasyWebie is not liable for content uploaded by users.

6.2 Our Intellectual Property

The EasyWebie platform, including its branding, code, design, templates, and interface, is owned by Web App Techie and protected by applicable intellectual property laws. You may not copy, reverse-engineer, or create derivative works of our platform without express written permission.

6.3 Third-Party Code Integrations

EasyWebie allows you to inject custom third-party scripts (such as analytics, tracking pixels, or marketing tools) into the <head> of your published website via the Analytics & Integrations feature. By using this feature, you agree that:

You are solely responsible for ensuring that any code you inject complies with all applicable privacy laws in your visitors' regions, including GDPR, CCPA, and the Indian DPDP Act 2023.
EasyWebie makes no warranty, express or implied, as to the functionality, accuracy, data collection behaviour, or fitness for purpose of any third-party service. If a third-party analytics or tracking service does not work as expected, that is the responsibility of the third-party provider — not EasyWebie.
You are responsible for obtaining any required cookie consent from your visitors before activating tracking services that require it (including Google Analytics 4, Facebook Pixel, and Hotjar).
EasyWebie reserves the right to scan and block code snippets that contain patterns associated with malware, cookie theft, or obfuscation. Blocked attempts are logged for admin review.

6.4 Free Plan Badge

Websites published on the Free plan must display the "Made with EasyWebie" badge. Removing or hiding this badge on a Free plan account constitutes a violation of these Terms.

7. Published Websites and Hosting

Published websites are hosted on Cloudflare Pages. We do not guarantee 100% uptime for published websites and are not responsible for downtime caused by Cloudflare outages. We reserve the right to take down published websites that violate our Acceptable Use Policy. For custom domain connections, you are responsible for maintaining valid DNS configuration.

Upon account deletion or subscription downgrade, published websites may remain accessible for up to 7 days before being removed from Cloudflare Pages.

8. Contact Forms and Data

When your website visitors submit contact forms, their data is stored in your EasyWebie account dashboard. You are the data controller for this visitor data and are responsible for handling it in compliance with applicable privacy laws (GDPR, etc.). You must have a privacy policy on your published website informing visitors how their data will be used.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WEB APP TECHIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Web App Techie and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your website content; (c) your violation of any applicable law or third-party rights.

12. Termination

Either party may terminate the agreement at any time. You may delete your account through the Service settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases. Your data will be deleted within 30 days following our data retention policy.

13. Archive Plan

The Archive plan is a read-only plan that keeps your published website live at a reduced cost. On the Archive plan: the website editor is locked (no new edits or AI generation), your site remains publicly accessible on Cloudflare Pages, and custom domains remain connected. You may upgrade to any paid plan at any time to restore full editing access. The Archive plan is not eligible for the 14-day money-back guarantee as it is a continuation plan, not a first-time subscription.

14. Copyright Infringement — Takedown and Counter-Notice

14.2 Reporting Infringing Content

We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe that content published through EasyWebie infringes your copyright, please send a written notice to our Designated Agent at support@easywebie.com with the subject line [DMCA Notice] including:

Identification of the copyrighted work you claim has been infringed
The URL of the allegedly infringing content on our platform
Your full name, address, telephone number, and email address
A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the owner
Your physical or electronic signature

We will review valid notices and remove or disable access to allegedly infringing content promptly. Repeat infringers will have their accounts terminated.

14.3 Counter-Notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to support@easywebie.com with the subject line [DMCA Counter-Notice] including:

Your physical or electronic signature
Identification of the content that was removed and its location before removal
A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
Your name, address, and telephone number, and a statement that you consent to jurisdiction of the courts in your location

Upon receipt of a valid counter-notice, we may restore the removed content within 10–14 business days unless the original complainant notifies us they have filed a court action.

For material changes, we will notify you by email at least 14 days in advance. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
